End User License Agreement
This EULA governs the Phantom application installed on your Mac. Phantom’s cloud services are also governed by the Terms of Service.

1. Agreement and license
This EULA is between you and Benaja Raphael Heger, operating Phantom from Haubenstrasse 32, 3672 Oberdiessbach, Switzerland (“Phantom”, “we”, “us”). You accept it by clicking the website’s Download button after being shown the linked legal notice, or through an affirmative acceptance at checkout. Installing the app does not by itself accept a version you were not shown.
We grant you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the compiled Phantom app on Macs you own or control, for personal or internal business use. The app is licensed, not sold. Accounts and cloud features remain services governed by the Terms of Service.
If you obtain Phantom from the Mac App Store, the license is limited to Apple-branded products you own or control and is subject to Apple’s usage rules.
2. Restrictions and ownership
Except where law or an applicable open-source license allows it, you may not sell, rent, sublicense, redistribute, or commercially host the proprietary app; bypass security, authentication, metering, or technical limits; misuse Phantom credentials or infrastructure; reverse engineer proprietary portions; or remove legal and attribution notices.
We and our licensors retain rights in Phantom’s proprietary software, service, interface, documentation, trademarks, and visual assets. Source code and third-party components released under the MIT License or another open-source license remain governed by that license.
3. Mac permissions and AI actions
Phantom may request access to your microphone, screen, Accessibility controls, files or folders you select, temporary clipboard content used for a requested feature, network, and an optional login item. Depending on the task, it may process audio, screenshots, running-app information, visible window titles, accessible controls, clipboard text, and selected files. It does not continuously watch your screen or passively inventory apps and windows; visual and app context is collected on demand when a submitted task needs it.
The in-app Action Policy has three modes. Observe only explains or annotates without changing your Mac. Limited local may open apps or links and scroll, while blocking clicks, typing, file access or changes, and connected-service actions. Autonomous allows actions without a per-action prompt within the capabilities and permissions you granted. This policy is a control boundary, not a guarantee that an AI action will be correct.
Within the selected Action Policy and available permissions, Phantom may click, type, scroll, launch apps, use shortcuts, read or modify files, or send actions to connected services. AI output may be inaccurate. You are responsible for supervising important work, checking recipients and amounts, protecting credentials, maintaining backups, and using suitable approval and spending controls. Do not rely on Phantom alone for safety-critical or high-impact decisions. The acceptable-use rules in the Terms apply.
You can revoke system permissions in macOS System Settings, disconnect services, or select a more restrictive Action Policy, although affected features may stop working. These changes do not undo actions already completed.
4. Privacy and third parties
Phantom uses Apple frameworks, external AI and infrastructure providers, connected services, and open-source components. Those services may have their own terms and privacy policies, and their licenses control their components where applicable.
The Privacy Policy explains what Phantom processes locally and through external providers, provider roles, local retention limits, cloud retention criteria, and your controls. When you submit a task that uses a cloud-backed feature, Phantom sends the provider the content needed to perform that request. A macOS permission enables local access but does not itself authorize every provider transmission; the feature you choose, the submitted task, connected-service authorization, this EULA, the Terms, and any separate consent required by law define that processing.
5. Updates and termination
Phantom periodically checks an HTTPS update feed for cryptographically signed releases. Automatic checking is enabled in the current release, while installation requires the applicable user or system authorization. We may provide security updates, bug fixes, or feature changes, and some updates may be required for cloud features to remain secure or compatible. Do not install a package that macOS cannot verify as signed and notarized by Phantom’s identified developer.
We will provide security and conformity updates, notice, and remedies required by mandatory consumer law. System requirements, supported versions, update information, and support details are stated on the Phantom website or in release notes. You are responsible for installing important updates within a reasonable time after notice where the law allows.
You may end this EULA by stopping use and deleting the app. We may terminate the license for a material breach, subject to any notice or cure rights required by law. Termination does not automatically cancel a subscription; use the applicable billing cancellation process. Rights granted independently under an open-source license remain unaffected.
6. Warranty and general terms
We will provide the app with reasonable care and skill and honor mandatory consumer rights. We do not promise that AI output will always be accurate or that third-party services will always be available.
The warranty and liability provisions in the Terms of Service apply to the app to the maximum extent permitted by law. Nothing excludes liability or rights that cannot legally be excluded.
The governing-law, dispute, change, severability, notices, and consumer-protection provisions in the Terms also apply. A materially changed EULA applies prospectively after any notice and renewed acceptance required by law. You may not export or use Phantom in violation of applicable export-control or sanctions laws.
7. Additional Mac App Store terms
This section applies only if you obtain Phantom through Apple’s Mac App Store.
- This EULA is between you and Phantom, not Apple. Phantom is responsible for the app and its content.
- Apple has no obligation to provide maintenance or support.
- If the app fails an applicable warranty, you may notify Apple, and Apple may refund the purchase price paid to Apple, if any. Phantom remains responsible for other warranty obligations required by law.
- Phantom, not Apple, is responsible for app-related product, compliance, consumer-protection, and intellectual-property claims.
- You must comply with applicable third-party terms and export or sanctions rules.
- Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it after your acceptance.
